What CBD products can be legally registered in Spain?
Currently, CBD cosmetics are one of the most viable categories for legal marketing in Spain and the European Union. These products must be notified in the European Commission’s CPNP portal, complying with Regulation (EC) 1223/2009. CBD food supplements are currently considered Novel Food and do not have authorization for marketing in the EU. In the veterinary field, CBD supplements for oral consumption are also not authorized in most cases. However, some topical products intended for animals can be marketed depending on their formulation and regulatory classification. Therefore, it is essential to correctly analyze the product category and the regulatory strategy before market launch.
What is the CPNP portal and how does it work?
The CPNP (Cosmetic Products Notification Portal) is the official portal of the European Commission where all cosmetics must be notified before marketing in the EU. For CBD cosmetics, you need to include: product data, complete composition, Product Information File (PIF) prepared by a qualified Safety Assessor, and labeling compliant with regulations.
How much does it cost to register a CBD product?
The cost depends on the product type and its complexity. It includes several components: legal advice for classification and strategy, PIF preparation by Safety Assessor (for cosmetics), laboratory analysis, and notification management. Can I sell CBD oil for ingestion if I register it as a cosmetic?
No. A product registered as a cosmetic can only be marketed for external topical use. Labeling or promoting it for oral consumption or ingestion would constitute a violation that may result in product withdrawal, administrative penalties, and even additional liabilities. Each product must be registered in the category corresponding to its actual use. In some cases, certain products can be formulated and registered as oral hygiene products (for example, mouthwash) within the cosmetic category, provided their use is clearly limited to oral hygiene without ingestion.
What THC limit should my CBD product have?
In CBD cosmetics there is no specific percentage limit for THC like the one applied to industrial hemp. European regulations require that the ingredients used are authorized and that the product does not contain THC or only technically unavoidable traces. Therefore, in regulatory practice it is recommended that THC be non-detectable or present only in minimal traces. In any case, the content should never exceed 0.3% THC, which is the limit generally accepted for industrial hemp in European regulations. To demonstrate this, it is essential to have certificates of analysis (CoA) issued by accredited laboratories, certifying the exact cannabinoid profile of the product.
Can I import CBD products from another country and sell them in Spain?
Yes, but you must comply with European regulations. If you import CBD cosmetics from outside the EU, you must designate a Responsible Person in the EU, adapt the labeling to the local language, have an updated PIF, and notify it in CPNP before marketing. I advise you throughout the import and regulatory adaptation process.
