The first thing you need to know about a cannabis cultivation trial
Before getting into statutes and penalties, the idea that organizes everything else.
Cultivating cannabis is not always a crime in Spain: the boundary lies in the destination of the cultivation. Proven personal use falls outside Article 368 of the Criminal Code, although it may result in an administrative sanction if the plants are visible to the public.
When there is a criminal charge, the trial is decided on three grounds: the validity of the search and seizure, the actual computation of the substance (only dried flowering tops, in net weight), and proof of destination. In our specialized criminal defense in cannabis matters, these three fronts are addressed from day one.
The three scenarios of cannabis cultivation
The same act—cultivating—can end in three very different pathways. Identifying early which one applies to your case is the first strategic decision of the defense.
Scenario 1 · Administrative pathway
Plants visible to the public
If the cultivation lacks criminal relevance but the plants are visible from the public thoroughfare (a balcony, a terrace, an open property), the Citizen Security Act comes into play. It is challenged through submissions and appeals, not in a criminal court.
Scenario 2 · Criminal pathway
Investigation under art. 368 CP
If the prosecution maintains that the cultivation was oriented toward trafficking, the cultivation falls under the acts of cultivation and production in Article 368. This is where the classic trial is fought: destination, expert evidence, and validity of proof.
Scenario 3 · Aggravated subtype
Notoriously large quantity in large-scale cultivation
Once 10 kg net of computable substance is exceeded, the prosecution invokes art. 369.1.5ª CP and the penalty increases by one degree. That is why expert weighing is decisive: a few grams up or down change years in the prosecution’s request, as also occurs in drug trafficking.
Personal use or trafficking? The boundary applied to cultivation
The law does not punish personal consumption, but it also does not set a magic number of plants. Two myths concentrate the majority of errors that are later paid dearly in court.
“Up to X plants is legal, everyone says so.”
That number does not exist in any statute. The courts assess the estimated yield of the harvest against the proven consumption of the individual: the number of plants is one more indication, weighed together with the rest of the circumstances of the case.
“If it’s for me, they can’t do anything to me.”
Personal use excludes the offense, but it must be possible to prove it, and in addition the administrative pathway remains open if the plants were visible to the public. What happens after police intervention, and how it is documented, conditions the entire defense, just as in defense for cannabis possession.
The indications that the courts weigh
Shared cultivation: possible, but with strict requirements
Case law admits shared consumption only under very limited conditions: a closed and stable circle of consumers, quantities adjusted to their consumption, absence of profit motive, and no distribution to third parties. Applied to collective cultivation, the margin is narrow and each requirement is examined closely. The computation of the substance: what counts and what does not
The prosecution usually starts from the gross weight of everything seized. Technical defense begins by recalling what international law considers cannabis and what the Supreme Court doctrine requires.
Counts as substance
- The flowering or fruiting tops of the plant, which are the only thing the 1961 Single Convention defines as controlled cannabis.
- In net and dry weight: after removing non-controlled parts and allowing the plant to lose its natural moisture.
- With THC potency analysis confirming that we are dealing with psychoactive substance and not hemp.
Should not count
- Roots, trunks, and stems, and in general the woody parts of the plant.
- Leaves not attached to the flowering tops and seeds, expressly excluded from the international definition.
- The fresh weight of whole plants just cut: moisture is not drug and weighing must be done dry.
The 10-kilogram rule
Case-law threshold for notoriously large quantity in cannabis (Supreme Court Plenary Agreement of 19/10/2001)
A nuance that surprises many defendants: in cannabis the 10 kg threshold is computed regardless of THC percentage, because the Supreme Court treats it as plant material that is not presented in pure form. THC potency still matters, and greatly, for something else: to rule out that the material is industrial hemp or another plant without relevant psychoactive effect.
And an honest warning: the flowering-tops criterion is established in Supreme Court doctrine, but there are rulings that have counted more parts of the plant. That is why the weighing is never taken at face value: the chain of custody is reviewed, the official report is challenged, and when appropriate, a counter-expert report is requested.
“What I see most in cultivation trials is that the weight used in the charge is almost never the weight that should be under discussion. Expert evidence often makes the difference between a basic type and an aggravated one.”
Gabriela Sierra · Lawyer specialized in cannabis lawSearch and seizure: your rights in the home
Almost all cultivation trials start the same way: someone enters where the plants were. How that entry occurred determines whether the evidence is valid or not.
The starting rule
The home is inviolable (art. 18.2 of the Constitution). Everything the prosecution finds inside depends on the entry being valid: if the origin fails, the evidence fails.
The three keys that open a door
There are only three legitimate pathways: the consent of the occupant (free, informed, and without coercion), a reasoned judicial order, or crime in flagrante, which the courts interpret restrictively. Perceptions from outside, such as odor, are examined case by case and do not automatically amount to flagrancy.
How the search must be conducted
In judicial searches, with presence of the interested party and the Court Clerk, and with a record that faithfully reflects what was found. Defects in the practice and in the chain of custody of what was seized are reviewed one by one.
If something was done wrong
The consequence may be nullity of the evidence (art. 11.1 LOPJ) and, depending on the connection between one piece of evidence and another, the collapse of derivative evidence. If there was also detention, it is advisable to read what to do if you are detained with cannabis.
How we prepare the defense in a cultivation trial
Each case is different, but the lines of work are repeated. These are the ones we always review, in this order.
- Validity of search and seizure: enabling authority, conduct of the procedure, and possible nullities.
- Expert computation: parts of the plant, net dry weight, THC potency, and counter-expert report when appropriate.
- Destination of the cultivation: proof of personal use or shared consumption against indications of trafficking.
- Chain of custody: path of the substance from seizure to laboratory.
- Proportionality and individualization: personal circumstances and mitigating factors that the prosecution usually does not consider.
- Administrative pathway: submissions and appeals against sanctions under LO 4/2015 when there is no offense.
Emergency analysis
Police report, manner of discovery of the cultivation, and procedural status. If there is detention, immediate assistance.
Expert evidence and computation
Review of weighing, potency, and chain of custody; technical challenge of the official report.
Strategy
Destination, nullities, and proportionality: the main front is chosen and exculpatory evidence is prepared.
Trial or appeal
Defense at oral hearing and appeals, or submissions in administrative proceedings if the case is a sanction file.
Does your cultivation have paperwork? Industrial hemp is another terrain
If we are talking about industrial hemp with certified seed and THC within the limits, the approach changes completely: the defense is primarily documentary and administrative, and the THC potency analysis becomes your best ally. We explain it in depth in the guide to industrial hemp cultivation in Spain.
Frequently asked questions about cannabis cultivation and its defense
The answers are general guidance: each case requires its own analysis.
Is it a crime to cultivate cannabis for personal use in Spain?
Cultivation intended exclusively for personal consumption falls outside the offense of Article 368 CP, which requires an orientation toward trafficking. However, that destination must be possible to prove, and if the plants were visible to the public, a sanction file under the Citizen Security Act may be opened. The real answer always depends on the specific circumstances.
How many cannabis plants can I legally have?
No Spanish statute sets a legal number of plants. The courts assess the foreseeable yield of the harvest against proven consumption, together with the rest of the indications (installation, scales, notes, witness testimony). The number of plants is a relevant indication, but not an automatic rule either for or against.
What is the penalty for a cannabis cultivation trial?
If convicted under the basic type of Article 368 CP (substances that do not cause serious harm to health), the penalty is 1 to 3 years’ imprisonment and a fine of one to two times the value of the drug. If notoriously large quantity is found (from 10 kg net of computable substance), the penalty increases to a range of 3 years and 1 day to 4 years and 6 months and the fine may reach four times the value. The outcome depends on the computation, the proven destination, and the validity of the evidence.
How is cannabis from a cultivation weighed in criminal proceedings?
What is controlled are the flowering or fruiting tops, in net and dry weight. Seeds and leaves not attached to the flowering tops are excluded from the international definition, and Supreme Court doctrine excludes roots, trunks, stems, and woody parts; it is also not appropriate to weigh whole fresh plants, because moisture is not substance. In practice, the weighing is reviewed and contested through expert evidence in each case.
Can the police enter my home because it smells like cannabis?
The home is inviolable and entry is only permitted with the consent of the occupant, a judicial order, or crime in flagrante. Flagrancy is interpreted restrictively, and perceptions from outside, such as odor, do not generate it automatically: the courts examine each situation in concrete terms. If the entry was irregular, the defense may request nullity of what was found.
What happens if my cultivation had a license or was industrial hemp?
Industrial hemp with certified seed and THC within legal limits is a lawful agricultural activity, and the controversy usually revolves around documentation, traceability, and potency analyses. When the prosecution questions the actual destination of the cultivation, the defense is primarily documentary and expert-based. We have a complete guide on the legal framework for industrial hemp in Spain.
A cultivation trial is decided in the details
The entry, the weighing, and the destination of the cultivation are examined case by case. The sooner yours is reviewed, the more room there is for criminal defense. Initial case assessment at no obligation.
