Arrested or reported for marijuana possession?

Carrying cannabis for personal use is not a crime in Spain, but it can result in a fine of hundreds or thousands of euros, and with the wrong evidence, in a charge for trafficking. We defend on both fronts: we appeal sanctions and undertake criminal defense, with urgent assistance to detainees throughout Spain. Getting caught with marijuana doesn’t make you a criminal

In Spain, possession of cannabis for personal use is not a crime. However, it does incur an administrative sanction when it occurs in public spaces: the Citizen Security Law punishes it with fines from 601 to 30,000 euros, in addition to the seizure of the substance. The serious problem arises when the quantity or circumstances lead the police to believe that the drug was not for you: then the fine turns into a trafficking investigation under Article 368 of the Penal Code, with prison sentences. This page, part of our specialized cannabis criminal defense service, explains what can happen to you, how we appeal fines, and how we defend each case, from identification on the street to urgent assistance if there is an arrest.

What Can Happen

The three possible outcomes when you’re stopped with cannabis

Not all encounters with police while carrying marijuana end the same way. The defense’s job is to push the case toward the most favorable scenario possible.

Most common

Administrative fine

Identification, seizure of the substance, and proposed sanction for possession or consumption in a public place. This is not a criminal procedure and does not generate a criminal record, and it can be challenged with allegations and appeals.

The serious scenario

Criminal investigation

If the quantity or evidence points to trafficking, there is an arrest or summons as an investigated party under Article 368. Here, every decision counts from the first minute, starting with not making a statement without a lawyer.

The defense’s objective

Dismissal or minimum sanction

With a well-planned defense, the realistic outcome is the dismissal of criminal proceedings due to personal use, the annulment of the fine due to procedural defects, or its reduction to the minimum amount.

The Decisive Question

Fine or crime? The border that decides your case

Everything revolves around a single question: who was the cannabis for? And that question isn’t answered by an automatic chart: it’s answered by the full set of circumstances in each case.

What keeps the case as a fine

  • Quantity compatible with a consumer’s supply, according to the indicative references handled by jurisprudence.
  • Consumer status that can be proven.
  • Substance not divided into doses and absence of scales, notes, or fractional money.
  • A coherent account and calm demeanor during identification.

What turns it into a criminal investigation

  • Quantities that clearly exceed personal consumption references.
  • Wrappings, baggies, or doses prepared for distribution.
  • Precision scales, sales messages, or prior police surveillance.
  • Sensitive contexts, such as proximity to schools or leisure centers.

A nuance that makes real differences: these indicative quantity references do not function as an automatic traffic light in either direction. There are dismissals with high quantities when stockpiling for personal use is well-proven, and there are convictions with small quantities when evidence of sale is present. If your case has crossed or may cross the threshold of Article 368 of the Penal Code, you should know how this area is defended on our drug trafficking defense page, the older sibling of this one.

Gabriela Sierra’s perspective

“I’ve been in the cannabis sector since 2012, and there’s something I still see every week: cases that are lost because they weren’t defended, not because they were indefensible. Possession is often the first time someone encounters the sanctioning or criminal system, and that inexperience is paid dearly if no one accompanies you. My job is to ensure that a bad day doesn’t turn into a conviction, an unjust fine, or a record that conditions your future. And that starts with something as simple as showing me the documents before deciding anything.”

Administrative Route

The fine for possession: how the procedure works and how we fight it

Key sanction details

  • Serious infraction of Article 36.16 of Organic Law 4/2015 for consumption or possession in public places.
  • Fine from €601 to €30,000, which in practice is almost always imposed at its lower end.
  • Voluntary payment with a 50% reduction: the minimum is €300.50, in exchange for waiving the right to appeal.
  • Does not generate a criminal record, although it is recorded for administrative purposes and recidivism.
1

Report and seizure

Officers identify you, seize the substance, and file a report. What you say and how you act here already forms part of the case file.

2

Notification

You receive the initiation of proceedings with the proposed sanction. From that moment, deadlines begin, and no option waits.

3

Pay or appeal

Early payment with a 50% reduction and closure of the case, or allegations disputing the facts, evidence, and procedure.

4

Resolution and appeals

If the resolution confirms the sanction, administrative appeal and, if applicable, administrative contentious judicial review remain.

And where do we attack? Where the case file often fails: reports with defects or lacking the elements required by the infraction, incorrect notifications, absence of substance analysis or reports that do not properly identify it, inconsistencies between what was reported and what was resolved, and disproportionality in the amount. Furthermore, there is a growing front that we know particularly well: seizures of CBD flowers mistaken for marijuana, where purchase documentation and the demand for an analytical test quantifying THC can dismantle the sanction, backed by the doctrine we analyzed following the Supreme Court ruling on CBD flowers. If you’ve been stopped while driving or want to understand that scenario, you have the complete guide on what happens if the police stop you with CBD.

Before paying the reduced fine, consult us: paying closes the case and waives all appeals. Sometimes it’s the right decision, and we’ll tell you with that honesty, but it’s advisable that someone who has seen the case makes it, not fear or haste. Deadlines are short: the sooner we see it, the more options there are.
Criminal Route

If there’s an arrest: the first hours decide the case

Cases don’t get complicated at trial: they get complicated at the police station, when the detainee, with the best intentions, says more than they should or consents to what they shouldn’t. These are the rights that protect anyone detained and the approach we apply.

1

Identify yourself and stay calm

Being courteous with officers isn’t weakness, it’s strategy. Resistance only adds new problems.

2

Exercise your right to remain silent

It’s a constitutional right that doesn’t harm you or imply guilt. You make a statement later, with the police report reviewed and a strategy defined.

3

Don’t consent to searches without a lawyer

Not of your home, vehicle, or mobile phone. A hasty verbal consent can validate what would otherwise be invalid.

4

Demand immediate legal assistance

You have the right to a lawyer from the first moment and to meet privately with them. Call your trusted defense attorney or have your family do so.

5

Don’t sign what you don’t understand

Ask them to explain each document and note any discrepancy before signing.

Arrest in progress right now? This is not the time to read: it’s time to call. Dial +34 659 892 587 and, if we don’t answer immediately, follow the emergency protocol on the contact page. We assist with arrests throughout Spain.

Our Method

How we build the defense in a possession case

Our working method

  • Complete study of the report or police record before any decision: without documents, there is no strategy.
  • Identification of nullities and procedural defects, which are the shortest path to dismissal.
  • Evidentiary construction of personal use when the case allows it.
  • Honesty about the real options for each path, including not appealing.

Validity of the Finding

The search, stop, or inspection that led to the finding must be legal: if it isn’t, the evidence derived from it can fall entirely.

Chain of Custody and Analysis

The weight and actual THC content matter: gross weight is never the legally relevant weight.

Consumer Status

Reports and testimony that prove personal use and dismantle the narrative of intent to traffic.

Shared Consumption

A doctrine with strict requirements that we know in detail from our daily work with cannabis social clubs.

When dismissal isn’t possible, the goal shifts: mitigated offense, mitigating factors, and a sentence that allows suspension—meaning a conviction that doesn’t result in prison time.

We answer your questions

Frequently Asked Questions about Cannabis Possession

Can I be arrested for carrying marijuana for personal use?

Possession for personal use is not a crime, so by itself, it should not lead to an arrest, but rather identification and an administrative report. Arrest occurs when officers perceive evidence of intent to traffic: a large quantity, prepared doses, or other elements. If it happens, the rights of the detainee apply: not to make a statement, not to consent to searches, and immediate legal assistance.

How much is the fine for marijuana possession?

Possession or consumption in public places is a serious infraction of Organic Law 4/2015, with a fine from €601 to €30,000. In practice, the vast majority are imposed at the lower end, and voluntary payment with a 50% reduction leaves the minimum at €300.50. The amount can increase with recidivism or circumstances, and it always entails the seizure of the substance.

Does a fine for possession give me a criminal record?

A criminal record, no: those only result from criminal convictions. The sanction is registered for administrative purposes and can count as recidivism if there are new infractions, but it does not appear on the criminal record certificate requested by companies or for public employment exams. Precisely for this reason, preventing a possession case from crossing into criminal territory is the defense’s number one objective.

What quantity of marijuana is considered personal use?

There is no legal figure that automatically marks the boundary. Jurisprudence uses indicative references based on average daily consumption and a reasonable supply for several days, but these function as evidence, not as a rule: one can be below and still be investigated if there are other elements of sale, and above with a solid defense of personal use. Distrust the miraculous tables circulating online: each case is evaluated as a whole.

Can my phone, car, or home be searched for possession?

Not freely. A home search requires judicial authorization, valid consent, or a flagrant crime, and access to mobile phone content is also protected and generally requires judicial authorization. A vehicle has less protection, but the search must be justified. Our constant recommendation: do not consent to any search without your lawyer present, because hasty consent can validate actions that would otherwise be null.

Is it worth appealing the fine, or is it better to pay it?

It depends on the case file, and anyone who answers without seeing it is not being serious. Paying with a reduction closes the matter for half the amount, but waives all defense; appealing makes sense when the report has defects, the substance analysis is missing, the product was documentable CBD, or the procedure presents irregularities. We analyze your notification and honestly tell you your real options, even if the answer is that it’s better to pay.

If your situation goes beyond possession (a formal charge for trafficking, cultivation, a club, or a CBD product), you have the complete overview of our practice on the specialized cannabis criminal defense page.
